What specific documents are required when selling a home in South Carolina?

1. Property Disclosure Form- This document, now required for all real estate transactions, requires you to reveal all known defects to your property. There are exemptions but in most cases, you are required by law, as a homeowner, to disclose all latent defects in writing.

2.Lead-Based Paint Disclosure Pamphlet - If your home was built before 1978, you are required to provide this pamphlet to all buyers and have them sign indicating they received a copy of this disclosure.  More information can be found in this Lead-Based Paint Pamphlet.

3. Sales Contract - This agreement is between you and the buyer stating the terms and conditions of sale. It is important to understand the entire contract and to review it prior to signing.

5. Addendum(optional) - If contingencies, or specific conditions, arise within a sale or purchase be sure to have this on hand. Keep in mind that the addendum overrides the original "Offer to Purchase".

5. Agency Disclosure Pamphlet(required by Licensees) - Be on the lookout for these. This document is a requirement, to be given and explained to you, by licensed real estate agents at first reasonable contact. It basically states who is representing the buyer and/or seller and is NOT A CONTRACT.
